Divorce Advice

Divorce is final step taken to sever the ties of a marriage usually taken when the couple thinks there is no way of working things out. A divorce can also be asked by one person who will be referred to as the petitioner when they find out the partner is unfaithful or is violent or simply because they are incompatible. The divorce rates have skyrocketed the past few decades and some feel it could be because the couple doesn't try to reconcile enough.

A mutual agreement to getting divorced is by far the easiest and the least bothersome route as it will be short and you will not have to go to a million hearings before you get the divorce. The divorce proceedings can also be taxing on children as it is very hard for them to see their parents separate.

Before filing for divorce, it is wise to go for marriage counseling and try to sort out the issues. Most often the issues will not be as bad as one imagines to be and can be worked out with a little help. The most difficult hurdle is to acknowledge that one might be wrong. Most of these issues are looked into in the marriage counseling sessions and there are a lot of marriages that were saved solely because of this.

Most often the marriages which have gone to the brink and then have been save are the strongest as they have something they had almost lost. But when it comes to domestic violence, the wisest thing to do is divorce in order to prevent harm to yourself or your children. Children with a violent parent will always be scarred inside and counseling usually doesn't work in such cases.

When you feel the differences are irreconcilable, divorce papers can be filed by filling a divorce form. The procedure can take a few months and can sometime take even a few years to get over. To resolve the issues of finances and children, court will have a few hearing if there is no mutual agreement and depending on the details given, the court will make a decision. If there are financial issues to be settled, the details of ones property, debts, savings, etc. will have to be submitted. The child dispute issues will be settled by the court by deciding with which party the needs of the child are best cared for. The time the child has spent with each parent, the living conditions of each parent and many other factors will come into play in deciding who gets the child's custody.

A shared custody is the best way to deal with the children issues as the child will still have time with both parents and you will not have the guilt of depriving your children of having a father/mother in their life. Most men will be expected to give child support or alimony which will be determined on his income.

Alimony can be given off in two ways. One is the lump sum way where a one time payment is done. The second is a monthly payment. Alimony is not a legal requirement and can be negotiated between the parties. Only if the parties cannot reach an agreement will the court decide the alimony.

A divorce where everything is agreed upon between the parties is the quickest and the expenditure is also at a minimum as all you will have to spend on is a filing fee and nothing on lawyers. In the light of reducing drama during the divorce and disturbing the minds of young children, uncontested divorces are the best and are the most widely done form of divorce.
